Will of Separate Case 1790 to 1844 Anderson
County, Kentucky In the name of God, amen, I Separate Case of the County of Anderson and State of
Kentucky, being sick and weak in body but of sound disposing mind and memory for which I
thank God, and calling to mind the uncertainty of human life and the certainty of death,
and being desirous to dispose of all such wordly estate as it has pleased God to bless me
with, I give and bequeath the same in manner following. I ----- to say I give ---Article 1st
I give and bequeath to my beloved wife Elizabeth Case all my estate perishable and
personal of every description subject to her controll (sic) to use and manage and dispose
of it as she may think proper during her natural life. Article 2 It is my wish and desire that at her death the said estate shall be disposed
of by my wife as she may think proper. I further desire that she divide it equally amongst
my legal heirs. Article 3 It is my wish and desire that no appraisment or sale shall take place after
my decease unless my wife may think proper, and when she may deem it necessary, she can do
so at her will and pleasure. And lastly, I do hereby constitute and appoint my beloved wife and my son John Case and
my son James Case Executors of this my last Will and Testament hereby revoking all other
former wills or Testaments by me heretofore made. In Witness Whereof I have hereunto set my hand and affixed my seal this 26th
day of October in the year of our Lord 1844, signed sealed published and declared as for
the last will and Testament of the above named Separate Case in presence of us the
undersigned Attest his Separate X Case Elizabeth Wash mark John Wash State of Kentucky, Anderson County I Jordan Walker, Clerk of the County Court for the County aforesaid, do certify, that
at a court house held for the County aforesaid at the courthouse in Lawrenceburg on Monday
the 10th day of February 1845, this writing purporting to be the last will and
testament of Separate Case was produce in hand and examined and proved by the oaths of
John /Wash and Elizabeth Wash the subscribing witnesses thereto to be the act and deed of
the said Separate Case, and the same was ordered to be recorded and filed, given under my
hand this 10th day of February 1845.
